Smith Douglas Homes LLC and its affiliates (collectively “Smith Douglas Homes” or the “Company”) respects your privacy and is committed to safeguarding your privacy rights. This Privacy Notice (the “Notice”) describes the types of personal information we collect about you when you visit our model homes, websites, social media accounts, or otherwise interact with us in connection with our products or services. 

This Notice applies to personal information we collect in any of the ways set forth below and describes the types of information we obtain, how we use it, with whom we share it, and the choices available to you regarding its use. You agree to this Policy and the use of your personal information as described in this Policy each time we collect information from you, so please read this policy carefully to understand how we gather, use, and treat your information. If you do not agree with our policies and practices, you should not use our website or otherwise provide persona information us in connection with our products or services. The Policy may change from time to time, and your continued use after any changes constitutes accept of those changes.

Our website is not intended for children under the age of 13 and we do not knowingly collect information from children under that age. If we become aware of inadvertent receipt of personal information from a visitor under the age of 13, we will delete the information from our records.

We maintain technical, administrative, and physical safeguards designed to protect personal information against accidental, unlawful, or unauthorized access, alteration, disclosure destruction, loss, or use. These safeguards may be updated from time to time as deemed necessary by the Company.

Information You Provide

Smith Douglas may collect personal information in various ways, such as when you visit our sales centers or websites. It may include:

• Your contact information, such as your name, email address, and phone number.
• Your street address, state, county, and zip code, along with information about your home preferences, such as price range, square footage, and property type.
• If you purchase a home with us, your marital status and military or veteran status.
• Information you submit through web forms or when you use interactive features of our websites. 
• Information you share when you interact with our sales representatives or other customer service personnel (e.g., buying preferences, communities of interest, etc.).
• Information you share when you participate in surveys, promotions, contests, and sweepstakes.
• Information from when you interact with our social media sites, such as Facebook, including your name, email address, and comment. We may communicate with you through social media and collect the information provide in response. This Notice does not cover the privacy and security practices of these social media sites.

Information we collect from you may be combined with information we obtain about you by automated means (as further detailed below), such as website usage details stored in cookies on your browser.

Information We Collect Using Automated Means

By doing so we can target our messaging to users of the website on other webpages and applications through interest-based and contextual means.  These companies may employ cookies and web beacons to measure advertising effectiveness and track users’ activities across different websites over time. The ad services use this information to show you ads that may be tailored to your individual interests. The information our ad services may collect on our behalf includes data about your visits to websites that serve our ads, such as the pages or ads you view and the actions you take on the websites. This data collection takes place both on this website and on third-party websites that participate in these ad services. This process also helps us track the effectiveness of our marketing efforts.

We may also use your information to protect against, identify, and prevent fraud and other unlawful activity, claims and other liabilities, and to comply with and enforce applicable legal requirements, relevant industry standards, contractual obligations, and our policies and Terms of Use.  We may also disclose without restriction aggregated information about our users and information that does not identify any individual. By providing such information to us, you are authorizing us to share such information with third-party entities.  If you do not consent to us sharing such information, do not provide such information.

 If you choose to make information available to the public through comment functions offered through our website or social media, this information will be visible to third parties. We do not control how recipients or persons who see the information may use or re-disclose it.

We may provide personal information about you to service providers and other third parties that perform functions on our behalf, and we may use it for any other purpose for which you provide it.

We also may disclose personal information: when required by law or (in our good faith determination) such action is necessary to comply with the law or legal process or assist with judicial or government proceedings; to protect our legal interests; or the disclosure is necessary for the safety Smith Douglas, its partners, or the public. 

Updating/Deleting Your Information or Opting Out of Communications

You can contact us through our online contact page or via email at privacy@smithdouglas.com to request access to or that we update or delete information you have previously provided. You can also review and update your personal information by logging into the website and visiting your account profile page. Deleting your personal information will require us to also delete your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you would like to opt-out of our marketing communications, please use the opt-out mechanism provided in the communication or contact us via our online contact page or via email at privacy@smithdouglas.com. Please specify the nature of your request. 

Tracking Technologies and Advertising. To stop tracking technologies and advertising (including targeted advertising), you can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this website may then be inaccessible or not function properly.

Third-Party Websites and Online Service

This Policy only applies to our website. To the extent our website includes links to other websites or online services operated by third parties, those third-party sites are subject to their own privacy policies. The Company does not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Smith Douglas Homes is not responsible for, and you expressly release Smith Douglas Homes from, any and all claims or damages that arise out of or relate to such third-party sites.
